Emma Zwemstra is an attorney at bureau Brandeis, within the Corporate & Commercial Litigation practice.

Her expertise and experience cover corporate and commercial matters in the broadest sense, often at the intersection of corporate law and liability. She advises and litigates on complex civil law matters, including:

• inquiry proceedings and other proceedings before the Enterprise Chamber;
• directors’ liability and other liability matters;
• shareholder disputes;
• disputes concerning commercial contracts;
• collective actions;
• employee participation matters (works councils); and
• (threatened) insolvency and WHOA restructuring proceedings.

Before starting her career as an attorney, Emma graduated cum laude in 2021 with a Master’s degree in Corporate Law, specialising in Commercial Private Law, from Utrecht University. Prior to this, in addition to obtaining a Bachelor’s degree in Law, she also obtained a Bachelor’s degree in Information Science (Department of Computer Science, Faculty of Science). Her Master’s thesis, entitled Afgeleide schade van aandeelhouders, received a grade of 9 out of 10, was nominated for the Molengraaff Prize, and was published as a book by a legal publisher (see the full reference below under “Publications”).

During and after her studies, Emma also gained relevant experience through internships and (part-time) positions at several renowned law firms, including within the M&A (mergers and acquisitions), employment law and financial litigation practices. She was also actively involved in the Molengraaff Dispuut and the Vereniging voor Corporate Litigation.
