Litigating in court, sometimes you have to. At the same time, proceedings can take a long time and a decision in court does not always completely resolve a dispute. Sometimes you still need to come to further (commercial) agreements, sometimes it is important to restore trust, because you simply have to move forward together.

Mediation can be a valuable way to resolve a conflict by mutual agreement. Not only legal aspects play a role, but also what really moves those involved can be put on the table. Also in the business context this form of alternative dispute resolution is increasingly used.

In addition to litigation and regulatory enforcement, bureau Brandeis also offers business mediation. As a mediator, we mediate between parties in dispute and help them find the relevant aspects of the conflict and the underlying interests and motivations. This with the goal of getting parties to reach agreements that are acceptable to both of them.

This may involve disputes with a customer, supplier, financier or shareholder, conflicts within board of directors, management team, partnership or partner group, and discussions between company and regulator or other government body.
